Court Halts OSHA’s Vaccination-or-Testing ETS

Update: On December 17th, the Sixth Circuit Court of Appeals lifted the stay on the OSHA vaccine-or-test mandate. See the main blog page for the latest information.

On Saturday, November 6, the Fifth Circuit Court of Appeals placed a temporary hold on the OSHA Emergency Temporary Standard (ETS) requiring COVID vaccination or testing for employees of employers with 100 or more employees.

The current ruling is temporary, but we expect to learn soon whether it will be extended.

The first deadline for employers subject to the OSHA ETS is December 5. We will maintain information about the ETS, including updates about the status of legal challenges to it, on the platform.
